Please read these Terms and Conditions carefully before using the Service.
Words with an initial capital letter have the meanings set out below. These definitions apply equally in the singular and the plural.
For the purposes of these Terms and Conditions:
These Terms and Conditions govern your use of the Service and form the entire agreement between you and AECORN. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.
You represent that you are at least 18 years of age. AECORN does not permit those under the age of 18 to use the Service.
Your use of the Service is also subject to AECORN's Privacy Policy, which is incorporated into these Terms by reference. Please read the Privacy Policy carefully before using the Service.
AECORN Realty Inc. is a licensed real estate brokerage registered with the Real Estate Council of Ontario (RECO) #5052279 under the Trust in Real Estate Services Act, 2020, S.O. 2020, c. 1, Sched. 4, (TRESA). All real estate activities conducted through this Service are subject to the requirements of TRESA and the applicable RECO Code of Ethics. Information provided on this Website is for general informational purposes and does not constitute real estate advice or a binding representation.
When you create an Account, you must provide accurate, complete, and current information at all times. Providing false or misleading information constitutes a breach of these Terms and may result in immediate termination of your Account.
You are responsible for maintaining the confidentiality of your password and for all activities that occur under your Account. You must notify AECORN immediately at info@aecorn.ca if you become aware of any unauthorized use of your Account or any security breach.
You may not use a username that impersonates another person or entity, infringes on the rights of any third party, or is offensive, vulgar, or obscene.
Your Right to Post Content. The Service may allow you to post Content. You are solely responsible for the Content you post, including its legality, accuracy, and appropriateness.
By posting Content, you grant AECORN a non-exclusive, worldwide, royalty-free licence to use, modify, publicly display, reproduce, and distribute your Content on and through the Service. You retain ownership of any Content you post and are responsible for protecting your rights in that Content.
You represent and warrant that: (i) you own the Content or have the right to use it and grant us the rights described in these Terms; and (ii) posting your Content does not violate the privacy rights, intellectual property rights, or any other rights of any person.
Content Restrictions. You may not post Content that is unlawful, defamatory, discriminatory, threatening, harassing, obscene, or otherwise objectionable under applicable Canadian law, including content that:
AECORN reserves the right, at its sole discretion, to remove Content that violates these Terms or that it deems inappropriate, and to limit or revoke your access to the Service in connection with such Content.
Content Backups. Although AECORN performs regular backups of Content, we do not guarantee against loss or corruption of data. You are solely responsible for maintaining an independent copy of any Content you post to the Service. AECORN has no liability for the integrity of Content or for any failure to restore Content to a usable state.
AECORN complies with Canada's Anti-Spam Legislation (CASL), S.C. 2010, c. 23. By creating an Account or submitting a contact form on the Service, you may provide express or implied consent to receive commercial electronic messages from AECORN, subject to the terms disclosed at the time of collection.
You may withdraw your consent to receive marketing communications at any time by clicking the 'Unsubscribe' link in any email or by contacting info@aecorn.ca. Withdrawal of consent will be processed within 10 business days. Transactional messages (such as account notifications and service-related communications) are not affected by an unsubscribe request.
Intellectual Property Infringement. AECORN respects the intellectual property rights of others and expects users of the Service to do the same. If you believe that Content posted on the Service infringes your copyright or other intellectual property rights under the Copyright Act, R.S.C. 1985, c. C-42, or applicable law, please submit a written notice to AECORN's designated representative:

The Service and its original content (excluding Content posted by users), features, and functionality are the exclusive property of AECORN Realty Inc. and its licensors. The Service is protected by copyright, trademark, and other Canadian and international laws.
AECORN's trademarks and trade dress may not be used in connection with any product or service without the prior written consent of AECORN.
You assign to AECORN all rights, title, and interest in any Feedback you provide. If such assignment is not effective for any reason, you grant AECORN a non-exclusive, perpetual, irrevocable, royalty-free, worldwide licence to use, reproduce, disclose, sub-licence, distribute, modify, and exploit the Feedback without restriction.
The Service may contain links to third-party websites or services that are not owned or controlled by AECORN. AECORN has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party site. We strongly recommend that you review the terms and privacy policies of any third-party websites you visit.
The listing information displayed on this Website is sourced from the Toronto Regional Real Estate Board (TRREB) MLS® System. AECORN Realty Inc. is a participant in the TRREB Virtual Office Website (VOW) program, which permits registered users to access certain MLS® data, including sold price information, subject to the terms below.
Accuracy of Listing Data. Listing information is provided for general informational purposes only and does not constitute a representation, warranty, or guarantee of accuracy, completeness, or timeliness. Listing data may change without notice, and AECORN makes no warranty that the information on this Website reflects current market conditions or the actual status of any property.
Restrictions on Use. MLS® listing data accessed through this Website may only be used for your personal, non-commercial purposes. You may not copy, redistribute, retransmit, publish, or otherwise reproduce any listing data obtained through this Website without the prior written consent of AECORN and TRREB.
VOW Access. Access to certain data — including sold prices and historical transaction records — requires you to create a registered Account. By accessing VOW data, you agree to use it solely for your personal property search and not for any commercial purpose. AECORN reserves the right to terminate your access to VOW data at any time if these terms are breached.
Trademark Notice. MLS®, REALTOR®, and the associated logos are trademarks of the Canadian Real Estate Association (CREA). TRREB MLS® data is used under license. This Website is operated by AECORN Realty Inc. and is not endorsed by CREA or TRREB.
AECORN may terminate or suspend your Account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service ceases immediately. You may terminate your Account at any time by discontinuing use of the Service or by contacting us at info@aecorn.ca.
To the maximum extent permitted by applicable law in Ontario and Canada, the entire liability of AECORN and its suppliers under any provision of these Terms, and your exclusive remedy for all of the foregoing, shall be limited to the greater of the amount actually paid by you through the Service in the 12 months preceding the claim, or five hundred Canadian dollars (CAD $500.00) if you have not made any payments.
To the maximum extent permitted by applicable law, AECORN and its suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including damages for loss of profits, loss of data, business interruption, personal injury, or loss of privacy arising from your use of or inability to use the Service, even if AECORN has been advised of the possibility of such damages.
Nothing in these Terms limits AECORN's liability for fraud, gross negligence, or any liability that cannot be excluded or limited under the laws of Ontario or Canada, including under the Consumer Protection Act, 2002, S.O. 2002, c. 30, Sched. A.
Some provinces or jurisdictions do not allow certain limitations of liability. If such restrictions apply to you, the above limitations will be applied to the greatest extent enforceable under applicable law.
The Service is provided to you on an "AS IS" and "AS AVAILABLE" basis, with all faults and without warranty of any kind. To the maximum extent permitted under applicable law, AECORN expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Without limiting the foregoing, AECORN provides no warranty that the Service will meet your requirements, be uninterrupted, error-free, or free of viruses or other harmful components, or that any defects will be corrected.
Nothing in these Terms is intended to limit any rights you may have under the Consumer Protection Act, 2002 (Ontario) or other applicable consumer protection legislation.
These Terms and your use of the Service are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario, and you hereby consent to the personal jurisdiction of those courts.
If you have any concern or dispute arising from the Service or these Terms, you agree to first attempt to resolve the dispute informally by contacting AECORN at info@aecorn.ca. If the dispute is not resolved informally within 30 days, either party may pursue the matter before the courts of the Province of Ontario.
Nothing in this section prevents AECORN from seeking injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information.
Severability. If any provision of these Terms is held to be unenforceable or invalid under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions of these Terms will continue in full force and effect.
Waiver. The failure of either party to enforce any right or require performance of any obligation under these Terms does not constitute a waiver of that right or obligation. A waiver of a breach does not constitute a waiver of any subsequent breach.
AECORN reserves the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to the new terms taking effect, either by email or by a prominent notice on the Service. What constitutes a material change will be determined at AECORN's sole discretion.
By continuing to access or use the Service after revisions take effect, you agree to be bound by the revised Terms. If you do not agree to the revised Terms, please discontinue use of the Service.
